EU ETS DOCUMENTS UPDATE: Regulation (EC) No 748/2009 through Commission Regulation (EU) 2024/1030

The European Commission has amended Regulation (EC) No 748/2009 through Commission Regulation (EU) 2024/1030, updating the list of aircraft operators performing aviation activities covered by Annex I of Directive 2003/87/EC. This regulation, published on 27 March 2024, ensures effective alignment with the European Union Emissions Trading System (EU ETS).

Purpose of the Update

The primary aim of this update is to streamline compliance by assigning each aircraft operator a designated Member State for oversight under the EU ETS. The new list reflects the latest operational data from Eurocontrol, ensuring only operators who performed relevant aviation activities during the past four calendar years remain included.

Key Amendments

  • Simplified List: Operators without aviation activity listed in Annex I of Directive 2003/87/EC for four consecutive years have been removed. This reduces administrative complexities and provides clarity for stakeholders.
  • Alignment with Data: The updated list incorporates the latest Eurocontrol data, enhancing precision and accountability.
  • Unchanged ETS Scope: The inclusion or exclusion of an operator in this list does not alter its obligations under the EU ETS, which depend solely on the nature of its aviation activities.

Implications

The revised regulation will foster transparency and efficiency in managing aviation emissions. It underscores the EU’s commitment to leveraging accurate data for climate accountability while reducing administrative burdens for operators.

This amendment highlights the EU’s proactive approach to refining emission monitoring frameworks and bolstering aviation’s contribution to climate goals.
